PRIVACY NOTICE ON THE PROCESSING OF PERSONAL DATA FOR JOB APPLICANTS

Pursuant to Article 10 of Law No. 6698 on the Protection of Personal Data (the "Law"), which entered into force on April 7, 2016, Atmosphere Yazılım ve Bilişim Hizmetleri A.Ş. (the "Company") acts as the Data Controller. This Privacy Notice is provided to inform you of our data processing activities.

Which of Your Personal Data Are Processed?

  • Identity Data: Your name, surname, date of birth, and marital status as provided in your CV and similar application documents.
  • Contact Data: Your phone number, email address, and residential address.
  • Visual Records: Your photograph, if voluntarily included in your CV.
  • Special Categories of Personal Data: Health data, including disability status, that you may submit to us.
  • Education Data: Your educational background, diploma information, foreign language proficiency, and any other educational details provided in your CV.
  • Professional Experience Data: Information regarding your previous employers and departments, employment dates, past job titles and positions, names and contact details (email addresses, phone numbers, employers, and titles) of your references, projects you have worked on, and your activities within those projects.
  • Other Data: Military service status, email correspondence during job interviews, and any hobbies or personal characteristics you choose to include in your CV.

How Is Your Data Obtained?

Your personal data is collected through automated or non-automated means, via electronic and/or physical environments. This includes information and documents you voluntarily provide, except for data specifically requested by us in job advertisements, and is obtained in the following ways:

  • When you submit your application to us via email,
  • When you complete our job application form,
  • When you make your data available to us through third-party job platforms (e.g., LinkedIn, Kariyer.net, SecretCV),
  • Through verbal disclosures made during interviews.

For What Purpose Do We Process Your Data?

  • To manage and evaluate job applications.
  • To conduct the Company's operations.

What Are the Legal Grounds for Data Processing?

Your personal data is processed based on the following legal grounds, as outlined in Article 5 of the Law. Please note that in cases requiring your explicit consent, no processing activity will occur without getting such consent beforehand:

  • It is necessary for the performance of job application processes.
  • To comply with legal obligations explicitly set forth in legislation.
  • It is necessary for the fulfillment of our legal obligations.
  • Where processing is necessary for our legitimate interests, provided that such processing does not prejudice your fundamental rights and freedoms.

To Whom Do We Transfer Your Data?

Your personal data is shared exclusively with Company employees involved in the recruitment process, strictly in proportion to the purposes outlined above.

Where Is Your Data Stored?

For operational purposes, we use Gmail, Google Chat, and Google Meet for communication; Google Calendar for meeting and calendar management; and Google Drive for file sharing. Consequently, data related to your interactions through these systems may be stored on servers located abroad. All other personal data you provide to us is stored on secure servers within Turkey.

Regardless of the server's location (within Turkey or abroad), the responsibility for implementing the necessary administrative and technical measures for server protection lies with the server providers. The Company cannot be held liable for any issues arising from these third-party services.

What Can You Do Regarding Your Personal Data?

We wish to inform you that you have the right to contact us at any time via the communication channels listed below to:

  • Ascertain whether your personal data is being processed.
  • Request information concerning the processed data.
  • Be informed of the third parties, both domestically and internationally, to whom your personal data has been transferred.
  • Understand the purpose of processing your personal data and whether it is used in line with that purpose.
  • Request the rectification, erasure, or destruction of your personal data, and the notification of these actions to third parties to whom the data has been transferred.
  • Object to any outcome detrimental to you resulting from the exclusive analysis of your processed data by automated systems.
  • Claim compensation for damages incurred due to the unlawful processing of your personal data.

Responsibility

We have implemented all administrative and technical measures to ensure the security of your personal data. However, we wish to inform you that the Company and its management cannot be held responsible for any cyber-attacks or unlawful acts beyond our control that may lead to your data being seized, used, altered, transferred to third parties, disclosed, or subjected to similar unauthorized operations.

To verify that the application originates from you, we may request additional, non-burdensome verification steps (e.g., sending a message to your registered phone number or making a phone call). We will process your request free of charge within a maximum of thirty days, depending on its nature and feasibility. However, should additional costs arise during the response process, a fee may be charged to you in accordance with the relevant legislation.
