Personal Data Clarification Text for Individual Business Partners, Company Representatives, and Employees

As Atmosphere Yazılım ve Bilişim Hizmetleri A.Ş. (“Atmosphere”/“Company”), acting as the Data Controller under Law No. 6698 on the Protection of Personal Data (“the Law”), effective April 7, 2016, we provide this Clarification Text to inform you of our obligations under Article 10 of the Law.

What Personal Data Do We Process?

  1. Identity Data: Your Name-Surname, and Turkish Republic ID number (if included in our contract).
  2. Contact Data: Your email address, workplace address, and telephone number.
  3. Professional Data: Your position within the company.
  4. Financial Data: Your bank account number, branch name, and IBAN (for individual business partners).

How Do We Obtain Your Data?

Your data is collected through various means, including:

  • Information you send to us via email or provide verbally.
  • Details included in contracts signed with you.
  • Processing of activities you perform under our contracts within our commercial records.
  • During the fulfillment of our contractual obligations (e.g., salary payments).
  • By recording and responding to requests concerning you from judicial authorities.

This data is obtained either physically or electronically.

For What Purposes Do We Process Your Data?

We process your personal data for the following purposes:

  • To communicate with you effectively.
  • To fulfill our obligations arising from contracts signed with you.
  • To comply with our legal obligations.
  • To ensure the security and legitimate interests of the Company.

What Are the Legal Grounds for Data Processing?

Your personal data is processed based on the following legal grounds, except in cases where your explicit consent is required under Article 5 of the Law (in which case no processing will occur without your prior explicit consent):

  • To comply with regulations explicitly stipulated in the legislation.
  • Because it is directly related to the performance of contracts we have concluded with you.
  • Because it is mandatory for us to fulfill certain legal obligations.
  • When data processing is necessary for our legitimate interests, provided it does not harm your fundamental rights and freedoms.

To Whom Do We Transfer Your Data?

Your personal data may be shared with public institutions and organizations, financial institutions (such as banks), our group companies, or other third parties. This sharing is limited to the purpose of performing the contract signed with you and is proportionate to the purposes stated above.

What Are Your Rights Regarding Your Personal Data?

You have the right to apply to us at any time to:

  • Ascertain whether your personal data is being processed.
  • Request any information regarding the processed data.
  • Understand the purpose of processing your personal data and whether it is used appropriately.
  • Know the third parties, both domestically and internationally, to whom your personal data is transferred.
  • Request correction of your personal data if it is incomplete or inaccurate.
  • Request the deletion or destruction of your personal data in accordance with Article 7 of the Law.
  • Request that corrections, deletions, and destruction processes be notified to third parties to whom your personal data has been transferred.
  • Object to any outcome against you resulting from the exclusive analysis of your processed data by automated systems.
  • Demand compensation for damages incurred due to the unlawful processing of your personal data.

You can exercise these rights by contacting us using the information provided below.

To verify that the application belongs to you, we may request additional verification steps (such as sending a message to your registered phone or calling you) that do not unduly complicate the application process. For example, if you apply via email, we may contact you through another communication method to confirm your identity.

We will process your request free of charge within a maximum of thirty days, depending on the suitability and nature of your request. However, if additional costs arise during the response process, you may be charged a fee in amounts determined within the framework of the relevant legislation.
